De Palestijnse vluchtelingenkwestie, die het resultaat is van de gebeurtenissen rond de geboorte van de staat Israël zeventig jaar geleden, blijft een van de grootste en meest langdurige vluchtelingencrises van het tijdperk na de Tweede Wereldoorlog. Alleen al in het Nabije Oosten zijn er meer dan zes miljoen Palestijnse vluchtelingen. Hun status varieert aanzienlijk afhankelijk van de staat of het grondgebied dat hen ‘opvangt’, het VN-agentschap dat hen bijstaat, en de politieke omstandigheden rond de kwestie Israël-Palestina waarmee de vluchtelingen van nature worden geassocieerd. In politieke discussies over het lot van de Palestijnse vluchtelingen wordt het internationaal recht vaak buiten beschouwing gelaten, terwijl het fundamenteel is voor zowel de ervaringen van Palestijnse vluchtelingen als voor de oplossing van hun benarde situatie.
Het nieuwe boek Palestinian Refugees in International Law van Francesca Albanese en Lex Takkenberg biedt een duidelijke en alomvattende analyse van de Palestijnse vluchtelingenkwestie in het licht van verschillende gebieden van het internationaal recht. Albanese en Takkenberg besteden onder andere aandacht aan het unieke regime dat voor hen is opgezet, hun status en rechten, maar ook hoe zij in de praktijk worden behandeld in ongeveer vijftig landen. In het boek onderzoeken de auteurs de relevantie van internationale normen voor het bieden van internationale bescherming aan Palestijnse vluchtelingen en hun zoektocht naar duurzame oplossingen.

The Palestinian refugee question, resulting from the events surrounding the birth of the State of Israel seventy years ago, remains one of the largest and most protracted refugee crises of the post-Second World War era. Numbering over six million in the Near East alone, Palestinian refugee’s status varies considerably according to the state or territory ‘hosting’ them, the UN agency assisting them, and political circumstances surrounding the Israeli-Palestinian conflict these refugees are naturally associated with. Despite being foundational to both the experience of the Palestinian refugees and the resolution to their plight, international law is often sidelined in political discussions concerning their fate.
Francesca Albanese’s and Lex Takkenberg’s new book Palestinian Refugees in International Law offers a clear and comprehensive analysis of the Palestinian refugee question in light of various areas of international law, shedding light on: the distinctive regime set up for them, their status and rights (as refugees, often stateless persons, protected at times of war and internal displacement) but also their actual treatment in about fifty countries. It ultimately probes the relevance of international norms to the provision of international protection for Palestinian refugees and their quest for durable solutions.
